Second-parent adoption is a valuable legal option for two unmarried individuals who want to share legal responsibilities and rights of the child or children they are raising together. Both heterosexual and same-sex couples in New York State have the right to pursue second-parent adoption. This may appeal to you if:
·You're seeking to adopt the biological child/ren of your partner ·You had a child through artificial insemination and now want your partner to be the other legal parent ·Your child was conceived by a surrogate and you and your partner want to legally adopt the child ·You previously adopted a child as a single parent, and now you want your partner to share legal rights. Second-parent adoptions are ideal for couples who are raising children together and aren’t married because they choose not to be or cannot legally marry. Both parents who commit to raising a family should be able to rest assured knowing their parental rights will be honored, upheld and respected in any and all situations. You also deserve to have decision-making authority in the event of an emergency or, unfortunately, the disability or death of your partner.
THE ADOPTION HOME STUDY
The adoption home study can incite feelings of anxiety and stress for prospective adoptive parents. This process, however, is designed to ensure that the child or children are being raised or will be raised in a safe, nurturing and stable environment. This is the opportunity for you to demonstrate to the court that the adoption is in the very best interest of your child/ren. The Freedman Center for Clinical Social Work conducts Adoption Home Studies for second-parent adoptions and many private adoptions.A Licensed Social Worker will conduct your home study within 1-2 visits to your home.It may initially seem like an overwhelming process, but with proper preparation it can actually be a very empowering experience that only reminds you of how important it is to provide your family with a loving, stable home.
